1. Acceptance of Terms

By accessing or using FundHive ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services. These Terms apply to all visitors, users, and others who access or use the Platform.

2. Eligibility

You must be at least 18 years of age to create an account, launch a campaign, or make donations on FundHive. By using our Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One person may not maintain more than one account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Campaign Guidelines

Campaign Creation

When creating a campaign on FundHive, you agree to:

  • Provide truthful and accurate information about your campaign
  • Use funds only for the stated purpose of the campaign
  • Provide regular updates to your donors on campaign progress
  • Respond to donor inquiries in a timely manner
  • Comply with all applicable laws and regulations

Prohibited Campaigns

The following types of campaigns are strictly prohibited:

  • Campaigns involving illegal activities or substances
  • Fraudulent or misleading campaigns
  • Campaigns promoting hate speech, violence, or discrimination
  • Personal investment or financial return schemes
  • Campaigns that infringe on intellectual property rights
  • Gambling or lottery-related campaigns

5. Donations

  • All donations are voluntary and at the donor's discretion
  • Donations are generally non-refundable unless the campaign is found to be fraudulent
  • FundHive does not guarantee that campaigns will achieve their fundraising goals
  • Donors acknowledge that FundHive acts as a platform and does not endorse specific campaigns
  • Anonymous donations will not display the donor's identity to the campaign creator or public

6. Fees & Payments

FundHive charges a platform fee on funds raised through campaigns. Current fee structures are displayed on our pricing page. Payment processing fees charged by third-party providers (e.g., Stripe, PayPal) are separate and in addition to our platform fees.

  • Platform fees are deducted before funds are disbursed to campaign creators
  • Fee rates may be updated with 30 days' prior notice
  • Detailed transaction records are available in your dashboard

7. Withdrawals

Campaign creators may withdraw funds according to the following guidelines:

  • KYC verification must be completed before first withdrawal
  • Minimum withdrawal amounts apply based on the withdrawal method
  • Processing times vary by method (typically 3-5 business days)
  • FundHive reserves the right to hold funds pending investigation if fraud is suspected

8. Intellectual Property

The FundHive platform, including its design, features, and content, is owned by FundHive and protected by copyright, trademark, and other intellectual property laws. Users retain ownership of content they upload but grant FundHive a non-exclusive, worldwide license to use, display, and distribute such content on the platform.

9. Limitation of Liability

FundHive provides the platform on an "as is" and "as available" basis. To the fullest extent permitted by law, FundHive disclaims all warranties, express or implied. FundHive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

10. Indemnification

You agree to indemnify and hold harmless FundHive, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the platform shall first be attempted to be resolved through informal negotiation. If a resolution cannot be reached, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association in San Francisco, California.

12. Termination

We may terminate or suspend your account at any time, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is harmful to our business interests. Upon termination, your right to use the platform will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the platform. Continued use of the platform after changes constitutes acceptance of the modified Terms.
