1. Acceptance of Terms

By accessing or using MenuCraft ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

MenuCraft provides a digital menu and online ordering platform for restaurants, cafés, and food service businesses. The Service allows you to create QR-code-accessible digital menus, receive customer orders, process payments, and analyze customer behavior.

3. Account Registration

You must register for an account to use most features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current information and to notify us immediately of any unauthorized access.

One person or legal entity may not maintain more than one free account. Accounts are non-transferable.

4. Subscription Plans & Payment

4.1 Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are exclusive of taxes, which will be added where applicable. Prices are in USD unless otherwise stated.

4.2 Free Trial

Some paid plans include a free trial period. After the trial, you will be charged unless you cancel before the trial ends.

4.3 Cancellation & Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We offer a 30-day money-back guarantee for first-time paid subscribers. No refunds are issued for partial months or annual plans beyond the 30-day window.

4.4 Plan Changes

Upgrades take effect immediately and are prorated. Downgrades take effect at the next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit illegal, harmful, or offensive content
• Impersonate any person or entity
• Conduct unauthorized data collection or scraping
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• List items that are illegal to sell in your jurisdiction

6. Your Content

You retain ownership of all content you upload (menus, images, descriptions). By uploading content, you grant MenuCraft a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of providing the Service.

You are solely responsible for your content and warrant that you have the rights to use all content you upload, including images and trademarks.

7. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by MenuCraft Inc. and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may suspend or terminate the Service for maintenance, security reasons, or as required by law. We will provide advance notice of planned maintenance when possible.

10. Limitation of Liability

To the maximum extent permitted by law, MenuCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability to you shall not exceed the amounts you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Account Termination

We may terminate or suspend your account immediately for violations of these Terms, fraudulent activity, or non-payment. Upon termination, your right to use the Service ceases. You may export your data within 30 days of termination; after that, data may be permanently deleted.

13. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Travis County, Texas.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Continued use after the effective date constitutes acceptance.
